Welcome to Word on the Street Productions LLC ("Word on the Street," "we," "us," or "our"). 3. License to Use Software and Games

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use our free software applications and games for your personal, non-commercial use.

4. License to Stream Music and Watch Films

Personal, non-commercial listening to our music or viewing of our films through authorized platforms (such as Spotify, Apple Music, YouTube, streaming services, theaters, or our official website) is permitted. This permission is limited to private enjoyment and does not grant you any rights to reproduce, distribute, perform, or display the Content publicly.

Unless expressly authorized in writing by us, you may not:

  • Reproduce, distribute, publicly perform, publicly display, broadcast, or stream our music or films

  • Create derivative works, remixes, edits, mashups, covers, or fan edits of our Content

  • Use our music or film Content in any commercial project, including but not limited to films, videos, advertisements, podcasts, livestreams, YouTube videos, TikToks, Reels, or other social media content

  • Sample, loop, or incorporate our music into other recordings

  • Sell, license, sublicense, or redistribute our Content

  • Train, fine-tune, or develop artificial intelligence or machine learning models using our Content

5. Licensing and Sync Inquiries

If you are interested in licensing our music, film, or other Content for use in a film, television show, advertisement, video game, podcast, social media channel, or any other commercial or public project — including sync licenses, master use licenses, or mechanical licenses — you must obtain written permission and a signed license agreement from us before any such use. 6. Steam-Distributed Games

Our games distributed on Steam are also subject to the Steam Subscriber Agreement and Valve Corporation's policies. In the event of a conflict between these Terms and Steam's terms regarding the Steam platform itself, Steam's terms will govern your use of the Steam platform, while these Terms continue to govern your relationship with us as the developer.

7. Free Software and Modifications

Our software applications and certain other Services are provided free of charge. We reserve the right to modify, suspend, or discontinue any Service at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the Services.

8. Updates

We may release updates, patches, or new versions of our Services from time to time. These updates may be required for continued use of the Services. By using the Services, you consent to automatic updates where applicable.

9. User-Generated Content

If our Services allow you to submit, upload, or share content (such as in-game content, mods, screenshots, comments, feedback, fan art, or other user submissions), you retain ownership of that content but grant Word on the Street Productions LLC a worldwide, royalty-free, non-exclusive, perpetual, irrevocable, transferable, sublicensable license to use, reproduce, modify, adapt, publish, distribute, and display that content in connection with operating and promoting the Services.

You represent and warrant that:

  • You own or have all necessary rights to any content you submit

  • Your content does not infringe any third-party rights (including intellectual property, privacy, or publicity rights)

  • Your content does not violate any applicable law

10. Prohibited Conduct

You agree not to:

  • Post content that is illegal, defamatory, obscene, hateful, or infringing

  • Impersonate any person or entity, including Word on the Street Productions LLC

We reserve the right to suspend or terminate your access to the Services at any time, with or without notice, for any reason, including violation of these Terms.

11. DMCA / Copyright Complaints

If you believe content on our Services infringes your copyright, please send a written notice to our designated agent containing:

  • Your physical or electronic signature

  • Identification of the copyrighted work claimed to have been infringed

  • Identification of the allegedly infringing material and its location

  • Your contact information (address, phone, email)

  • A statement that you have a good-faith belief that the use is not authorized

  • A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner

We may remove allegedly infringing material and terminate the accounts of repeat infringers.

12. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

We do not warrant that the Services will meet your requirements or that any defects will be corrected. You use the Services at your own risk.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WORD ON THE STREET PRODUCTIONS LLC, ITS OWNERS, MEMBERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.

Our total liability to you for any claim arising out of these Terms or the Services shall not exceed one hundred U.S. dollars ($100.00) or the amount you paid us in the past twelve months, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so these limitations may not apply to you.

14. Indemnification

You agree to indemnify, defend, and hold harmless Word on the Street Productions LLC and its owners, members, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Services, your violation of these Terms, or your violation of any rights of another.

Our Services may contain links to or integrate with third-party services (such as Steam, Spotify, Apple Music, YouTube, social media platforms, or analytics providers). We are not responsible for the content, policies, or practices of any third-party services. Your use of those services is subject to their own terms.

17. Termination

We may terminate or suspend your access to the Services at any time, without notice or liability, for any reason. Upon termination, your license to use the Services ends immediately, and you must stop using and uninstall our software and games. Sections relating to intellectual property, user-generated content, disclaimers, limitation of liability, indemnification, and dispute resolution survive termination.

We may update these Terms from time to time. The "Last Updated" date at the top reflects the most recent version. Continued use of the Services after changes constitutes acceptance of the updated Terms. For material changes, we will provide reasonable notice (such as a notice on our website).

19. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of law principles. These Terms, along with our Privacy Policy, constitute the entire agreement between you and Word on the Street Productions LLC regarding the Services.
